New Privacy Deal May Not Actually Stop U.S. Snooping
An agreement to protect personal data sounds great, but critics say it may not mean much in practice.
02/02/2016 06:44 pm ET
·         Damon BeresTech Editor, The Huffington Post

A new deal reached between the United States and European Union Tuesday would allow American companies like Facebook to continuing collecting personal data from people who live across the Atlantic.
While this might make business easier for corporations, experts are worried that without reform of surveillance laws in the United States, the new arrangement -- known as the EU-U.S. Privacy Shield -- could still leave people vulnerable to the prying eyes of the American government.
"While the agreement should provide some increased privacy protections for the personal data of EU citizens, ultimately without reform of U.S. surveillance law, Privacy Shield will not be enough," Jens-Henrik Jeppesen, the director for European affairs at the nonprofit Center for Democracy & Technology, told The Huffington Post in an email.
There's A Complicated History Here
The deal is supposed to prevent "indiscriminate mass surveillance" of the data transferred to the U.S. from Europe. In other words, a European citizen using Facebook in Germany should feel confident that the U.S. government won't be able to access their photos and posts.
European citizens didn't have that confidence until last fall, when the EU struck down the "Safe Harbor" agreement. The terms of Safe Harbor allowed the free exchange of data between the U.S. and Europe, which the EU ultimately wasn't cool with. The whole kerfuffle started because an Austrian citizen named Maximilian Schrems sued Facebook for holding on to his data in the U.S. even after he'd deleted it in his home country -- which in turn meant it could be accessed by U.S. public authorities.
If your head is spinning, you're not alone. This exchange of data is a complicated mess in part because the policies governing the old Safe Harbor agreement originated in the 1990s, before the Internet was a) in everyone's pocket and b) full of multinational companies trying to make money off your status updates and photo uploads. Schrems essentially helped officials realize how much the world had changed.

What This New Deal Actually Means
In theory, the Privacy Shield agreement should protect European citizens from having their data picked apart by government agencies across the Atlantic. But there's concern that the pact won't be upheld without an actual overhaul of U.S. surveillance law.
"Both the U.S. Congress and EU Member States should act quickly to reform their surveillance laws and practices to be more aligned with international human rights norms," Jeppesen told HuffPost.
He wasn't alone in expressing skepticism. Edward Snowden, the famous whistleblower behind the 2013 National Security Agency leaks, blasted the move on Twitter.
The Privacy Shield agreement rests on "written assurances" about surveillance given to Europe by the U.S. There's a new "joint review" process to help ensure that everything's aboveboard. European citizens will be able to file formal complains, and there will be a "new ombudsperson" to manage it all.
You'd think privacy advocates would be elated, but it's unclear what any of this will mean in practice, as U.S. law still allows the surveillance of foreigners.
Given that, you can probably expect the deal to be challenged, if not rejected altogether.

Tabula Rosa Systems Blog For 2/3/2016 - From The US Department Of Homeland Security - Tuesday, February 9, is Safer Internet Day

From The U.S. Department of Homeland Security

This Tuesday, February 9, is Safer Internet Day 2016 – a worldwide effort to make the Internet a safer and better place for all.

In our ever-connected world, Americans are spending more and more time online. Three out of four cell phone owners (76%) never or rarely turn their mobile devices off, according to a recent Pew Research PLAY YOUR PART FOR A BETTER INTERNET -  study. As our lives become increasingly connected to technology the safety and security of the Internet becomes even more critical. This year’s Safer Internet Day theme – “Play your part for a better Internet” – reminds us that we all have a role to play in making the Internet safer and more secure.
Fortunately, there are many ways to have an impact and make the Internet safer. Here are three ways you can get involved in Safer Internet Day:

In honor of Safer Internet Day, the Stop.Think.Connect. Campaign encourages you to make online safety a priority. You don’t need to be an IT professional to protect yourself online; start with these simple tips while using the Internet at home or on the go:
  • Set strong passwords. Use complex passwords with a combination of numbers, symbols, and letters (upper and lower case).
  • Be wary of public Wi-Fi. Although convenient, most public Wi-Fi networks are not secure. Don’t conduct any sensitive activities, such as online banking or shopping, while connected to public Wi-Fi.
  • Keep software updated. Running the most recent versions of your mobile operating system, security software, apps and Web browsers is among the best defenses against online threats.
To learn more about how you can partake in Safer Internet Day, please visit saferinternetday.us/get-involved-2016. For more information and resources, please visit dhs.gov/stopthinkconnect.

Netiquette Core Principals For Truthful Disclosures Via Tabula Rosa Systems

The following excerpt is from my book, “Netiquette IQ - A Comprehensive Guide to Improve, Enhance and Add Power to Your Email"
 =======================================================
Netiquette Core Principals For Truthful Disclosures
Plato
"We know it's easy to lie on the Internet,"  Russ Clark

Good Netiquette is most often characterized with less verbose and more effective word usage. Nevertheless, even the simplest statements, paragraphs, or sentences can and should have not only good basics but also good logic, reasoning, and arguments. Even with perfect grammar, tone, content, and structure, poor logic or fallacies can significantly undermine the intent and content of even the simplest of emails.

The study of logic dates back to ancient Greece and has always been an integral part of reasoning and providing arguments or theories. There are some basic rules of logic that should always be applied to communication. The following identify some of these and provide some brief examples of how each can be misused:
1.   False dilemma—This argument states that a solution must be one of two choices: Either we support the war, or we are unpatriotic.

2.   Ad hominem—Using a personal part or belief of a person to prove an argument: Because English is not his first language, he cannot write good emails.

3.   Straw man (argumentum ad logicum)—This statement generalizes a viewpoint and then belittles it by extending it beyond its original premise: The president vetoed the oil companies’ exemptions; therefore, he is against large corporations.

4.   Red herring (ad misericordiam)—This attempts to evoke pity to aid in a request: This job should be given to me because I have not worked in two years.

5.   Slippery slope (non sequitur)—This fallacy assumes one action or condition will lead to a different condition: If I am not hired for this position, your customers will buy from someone else.

6.   Repetitive argument (argumentum ad nauseam)—This is an assertion made over and over to try to prove a point: As I have told you in my last three emails, you should give my staff a raise to increase productivity.

7.   Argumentum ad antiquitatum—A statement that asserts something must be right because it has traditionally been done the same way: We have never had email complaints, so there’s no need to add disclaimers.
